Basics of Car Lemon Law Explained

Are you a frustrated car buyer who doesn't get full value for every dollar paid towards buying an expensive car? Have you notified the dealership of the brand new car's recurring problem, but they haven't yet been able to rectify it even after multiple visits to the workshop? Then you have a lemon car in your hand.

Today we look at the basics of lemon law for a car.

What makes a car a lemon?

The main purpose of the lemon law is to protect the consumer from being defrauded by car manufacturers. A single defect in a car that prevents it from being used in normal use can be the basis for filing a complaint.

Here is the lemon law definition. Any new car that develops one or more problems within 18 months or 18,000 miles (29,000 km) involving the same part is considered a lemon. Unfortunately, some states have a shorter warranty period and mileage limit for filing a complaint.

The car manufacturer may fail to repair your new car. Plus, it has been in their custody for at least three repair attempts over a period of 30 days.

Under the US lemon law, you can ask for compensation under such a scenario.

What are the options available under compensation?

Now that you know what makes a car a lemon, let us now see what compensation options are available to the winning plaintiff.

One is to ask for a replacement vehicle of the same type or a similar model of your choice.

Another option is to ask for a refund of the money that you paid for buying the new car. Plus, you get an additional sum as compensation up to 15% of the purchase price. This amount can be used towards buying a new car by you.

Why do you need a capable lawyer for lemon law?

- If you have to fight for your own rights, it is highly recommended that you hire a dedicated attorney.

- A lawyer with experience in lemon law will be able to guide you through the process and ensure that the manufacturer takes appropriate action in resolving your problem.

- The lawyer can negotiate with the manufacturer for a higher amount of compensation than what is sought by you.

- The attorney can write to the manufacturer and initiate the lemon law procedure on your behalf. They will take over the responsibility of getting your faulty vehicle repaired timely and properly.

- Your lawyer will be able to handle all correspondence with the manufacturer concerning your case and keep you updated on how things are progressing.
